This policy outlines how we handle copyright infringement claims and Digital Millennium Copyright Act (DMCA) takedown requests.

Respect for Intellectual Property

We respect the intellectual property rights of others and expect our users to do the same. Because our SmarterMail infrastructure allows members to store and publicly share files via generated links, it is our strict policy to respond rapidly to clear notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (DMCA).

Filing a DMCA Takedown Notice

If you believe that content available through a public link or hosted on our network infringes your copyright, you may submit a formal DMCA takedown notice. Your notice must include the following information:

  1. Identification of the copyrighted work: A description of the copyrighted work that you claim has been infringed, or, if multiple works are covered by a single notification, a representative list of such works.
  2. Identification of the infringing material: Identification of the material that is claimed to be infringing, including the specific cubely.me URL or public link location where the file can be found.
  3. Your contact information: Your name, physical address, telephone number, and email address.
  4. Good faith statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. Accuracy statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of the copyright that is allegedly infringed.
  6. Signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

Where to Send Notices

All DMCA takedown notices must be sent to our designated copyright agent exclusively via email at the address below. Physical mail submissions are not accepted.

Counter-Notification

If a file you hosted or shared was removed or disabled by mistake or misidentification, you may file a formal counter-notification. Your counter-notification must include:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed and the specific link location where it appeared before it was disabled.
  3. A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, telephone number, and a statement that you consent to the jurisdiction of the federal court system for the judicial district in which our server infrastructure is located, or where the platform administrator may be found.

Repeat Infringers

In accordance with the DMCA and our upstream network rules, we have adopted a zero-tolerance policy for severe or repeat copyright violations. We reserve the right, at our sole discretion, to immediately terminate the mailbox access and hosted files of any user who infringes the intellectual property rights of others.

Modifications to Policy

We reserve the right to modify this DMCA and Copyright Policy at any time to adapt to new regulatory protocols. Changes will be effective immediately upon being posted directly to this page, and you can see when the policy was last updated by checking the timestamp at the top of the document.
